Although among Brazilian jurists many of those who study reform in isolation from the economic, social and even other branches of government, the majority still connects with recipes reform of the World Bank for Latin America, aimed at protecting the interests of transnational corporations. This would require a change is not in itself the judiciary and its transformation in the context of changing state model. Disputes of this part of the jurists revolve around the question of what kind of state model meets the ongoing reform of the judicial system. Some believe that it is a return to the «minimum» liberal state, others see the process to establish a democratic state, and others - the legal democratic welfare state.Статья посвящена заключительной фазе длительного процесса экономической, социальной и политической трансформации Бразилии, которая выражается в реформировании судебной системы страны. Хотя среди бразильских правоведов немало тех, кто изучает реформы в отрыве от экономики, социальной сферы и даже других ветвей государственной власти, большинство все же связывает реформу с рецептами Всемирного банка для стран Латинской Америки, нацеленными на защиту интересов транснациональных корпораций. А для этого необходимо изменение не самой по себе судебной власти, а ее трансформация в контексте смены модели государства. Споры среди этой части правоведов ведутся вокруг вопроса о том, какой именно модели государства отвечает проводимая реформа судебной системы.
