The relentless pressure to win can contribute to negative emotional consequences for lawyers, including demoralization, anxiety, anger and sadness, potentially leading to marital issues, mental health problems, and substance abuse. Moreover, both the accused and the victim frequesntly express dissatisfaction with case outcome, especially when cases are resolved through plea bargain. Recognizing the need for a holistic and interdisciplinary approach to solving legal problems, a trend is emerging away from adversarialism and toward problem-oriented methods for resolving criminal cases. Drawing on the experience of Victoria, Australia, this article explores the potential of restorative and therapeutic justice techniques, which are rooted in the practices of tribal courts of indigenous Australians. It examines the evolving role of the lawyer as a mediator and conciliator within the framework of alternative dispute resolution.</p></abstract><trans-abstract xml:lang="ru"><p>Жесткая состязательная модель уголовного правосудия, представляющая собой «игру с нулевой суммой» - выигрыш одной стороны означает проигрыш другой, вызывает все большее неприятие, как со стороны самих юристов, так и стороны общества. Постоянная необходимость побеждать способствует развитию у адвокатов хронических негативных эмоциональных реакций, таких как деморализация, тревога, гнев и печаль, что приводит к проблемам в браке, психическим заболеваниям и злоупотреблению психоактивными веществами. Обвиняемый и потерпевший также зачастую не получают полного удовлетворения от исхода дела, в особенности если дело заканчивается заключением сделки о признании вины. Возникает потребность в целостном и междисциплинарном подходе к решению проблем в области права, в связи с чем развивается тенденция отхода от состязательности и восприятия так называемого проблемно- ориентированного подхода к разрешению уголовных дел. На примере практики штата Виктория, Австралия, в статье исследуются возможности использования техник восстановительного и терапевтического правосудия, которые уходят своими корнями в практику племенных судов коренных народов Австралии.
