The authors assess the global practice of resolving digital disputes through arbitration, as well as the new form of digital rights protection - blockchain arbitration. They analyze regulation of the new procedure for the protection of digital rights in foreign practice. The authors believe that the developed foreign experience in resolving smart contracts is progressive and effective. The findings of the research can be outlined as follows: 1) for the first time, special rules for resolving digital disputes have been formulated; they have been developed in tight cooperation of lawyers and IT specialists; 2) disputes from smart contracts and blockchain were isolated into a separate form of rights protection; 3) special approaches to settling digital disputes at the stage of concluding smart contracts have been worked out; 4) the process of enhancing the procedure for resolving digital disputes is ongoing.</p>
Авторы полагают, что разработанный зарубежный опыт разрешения смарт-контрактов является прогрессивным и эффективным: 1) впервые появились специальные правила разрешения цифровых споров, в разработке которых участвовали не только юристы, но и IT-специалисты; 2) выделены споры из смарт-контрактов и блокчейна в отдельную форму защиты прав; 3) разработаны специальные подходы урегулирования цифровых споров на этапе заключения смарт-контрактов; 4) происходит постоянный процесс совершенствования процедуры разрешения цифровых споров.</p></trans-abstract><kwd-group xml:lang="en"><kwd>digital financial assets</kwd><kwd>digital rights</kwd><kwd>arbitration</kwd><kwd>blockchain arbitration</kwd><kwd>smart contract</kwd><kwd>digital disputes</kwd><kwd>digitalization</kwd></kwd-group><kwd-group xml:lang="ru"><kwd>цифровые финансовые активы</kwd><kwd>цифровые права</kwd><kwd>арбитраж</kwd><kwd>блокчейн-арбитраж</kwd><kwd>смарт-контракт</kwd><kwd>цифровые споры</kwd><kwd>цифровизация</kwd></kwd-group><funding-group><funding-statement xml:lang="en">This work was financially supported by the Grant of the President of the Russian Federation No. НШ-3270.2022.2 “Evolution or revolution of civil justice: digitalization through the prism of artificial intelligence”.</funding-statement><funding-statement xml:lang="ru">Работа выполнена при финансовой поддержке Гранта Президента РФ № НШ-3270.2022.2 «Эволюция или революция гражданского судопроизводства: цифровизация через призму искусственного интеллекта».</funding-statement></funding-group></article-meta></front><body></body><back><ref-list><ref id="B1"><label>1.</label><mixed-citation>Bezbakh, V.V. &amp; Frolova, E.E.
